1. Controller

The controller for the processing described here is [BidHome AG], [registered office address], Switzerland ([CHE-000.000.000]). Data-protection contact: [privacy@bidhome.ch]. This policy complies with the revised Swiss Federal Act on Data Protection (FADP) and, where applicable, the GDPR.

2. Data we process

3. Purposes & legal bases

We process personal data to: operate the Platform and conclude and perform contracts (auction participation, listings, completion); verify identity and comply with legal obligations including KYC/AML; prevent fraud and ensure auction integrity (legitimate interest); provide support; send service and, with consent where required, marketing communications; and produce aggregated analytics. Under the FADP, processing is justified by contract performance, our legitimate interests, legal obligation, and — where stated — your consent, which you may withdraw at any time.

4. Sharing & recipients

We share data only as necessary with: the counterparty to a transaction (to the extent needed to complete it); the assigned Swiss notary and, where relevant, the land registry; escrow, banking and payment partners; identity-verification providers (SwissID); and service providers such as our Swiss hosting provider (Infomaniak). We do not sell personal data. Recipients are bound by confidentiality and data-protection obligations.

5. International transfers

Data is hosted in Switzerland. Where a recipient is located in a country without an adequate level of protection, we apply appropriate safeguards (such as the Swiss Standard Contractual Clauses) as required by the FADP. Details are available on request at [privacy@bidhome.ch].

6. Retention

We retain personal data only as long as necessary for the purposes above and to meet legal retention obligations (for example, accounting and AML record-keeping periods under Swiss law), after which it is deleted or anonymised.

7. Security

We apply appropriate technical and organisational measures — including encryption in transit, access controls, and segregation of escrow funds — to protect personal data against unauthorised access, loss or misuse.

8. Your rights

Subject to legal limits, you may request access to, and rectification or deletion of, your personal data; object to or restrict certain processing; withdraw consent; and receive certain data in a portable form. To exercise these rights, contact [privacy@bidhome.ch]. You also have the right to lodge a complaint with the Swiss Federal Data Protection and Information Commissioner (FDPIC).

9. Cookies

We use strictly necessary cookies to operate the Platform and, subject to your choices, analytics cookies to improve it. You can manage non-essential cookies through the cookie banner and your browser settings.

10. Automated decisions

Proxy bidding and fraud-detection use automated processing to determine the visible price and to flag suspicious activity. These do not produce legal effects concerning you without human review, except the automatic operation of the auction mechanics you have agreed to.

11. Changes & contact

We may update this policy; material changes will be notified. Questions or requests: [privacy@bidhome.ch].
